A word of Caution to those taking DOGE to Court

Our good friend Richard “Swingin’ Dick” Long has learned a thing or two over life. Some of his more famous sayings are:

Be careful what you wish for or pursue–you may well get it.

If you’re tinkering with something that’s working, exercise caution. It might not be pretty, it might be old. But if it’s working you CAN break it and you CAN make things worse. Sometimes it’s better to leave things alone.

If you’re breaking some pretty major rules, it’s wise not to draw attention to yourself. As you know I carry my pistol just about everywhere. Never had an issue. But if I made a point of being a ‘Dick’ it’s likely I WOULD be found out and find myself in some trouble.

It seems like those who’ve filed a flurry of lawsuits (‘judge shopping’ and looking for a liberal activist judge) haven’t learned some of these life lessons. What do you expect; they’re leftist Democrats who always believed themselves above the law and untouchable (and as we’ve said in the past are usually the first ones to chant ‘no man is above the law’–while doing everything they can do to operate above the law). Extreme virtue signaling by those without virtue.

And it’s almost comical to hear those in unelected executive branch bureaucracies lament how ‘unelected’ Musk is going in with his ‘Whiz Kids’ to have a look at THEM. The President has full authority (and responsibility, by the way) of auditing these empires. They’ve dictated to US what kind of shower heads and light bulbs we can buy (and put those dang annoying dingers on cars for decades); yet when the middle level bureaucrat who fancied himself as someone of kingly authority–telling the masses what to do in his own corner–gets put under the microscope he howls and looks for cover.

There’s no question the President can bring in really anyone he deems fit to inspect the executive branch and see how it’s functioning; the constitutional power rests with the executive in the matter (as does Federal law support). When they actually FIND the fraud, waste, and abuse, the abusers on the gravy train howl publicly–mostly out of fear THEY’LL be found out. And cower behind the empire of unelected bureaucracy to ‘protect’ them.

Their primary strategy seems to be filing a flurry of lawsuits–“Judge Shopping” for a friendly liberal activist judge to issue some form of injunction (creating an unnecessary ‘constitutional crisis’ in the mean time because it’s at the discretion of the executive as to whether he’d actually COMPLY with an activist judge making up law or bending it to the point of breaking it).

But as one of our Principals (Keshawndra Johnson) warns:

“If they were MY clients, I’d have them back off right away. Especially if they are covered by a CBA and/or unionized.

Public sector unions have always been a minefield. Sometimes they can work OK–good police and fire unions seem to have a good track record; perhaps because they are moral people in general; perhaps because they have a keen understanding of the law. But the legitimacy of public sector unions is WAYYYYYYYY unsettled law. If you remember during Reagan, without batting an eye he fired striking Air Traffic Controllers; while this was fought in court (by F. Lee Bailey to boot) it was unanimously rejected and the canned controllers remained canned.

It’s possible–and likely–that if the issue is pressed TOO hard, it’ll wind up in front of the Supreme Court. While we don’t think much of Waffling Roberts, the court DOES have a relatively conservative majority.

And I believe it’s VERY likely they’ll rule that the average bureaucrat doesn’t have the protection he thinks he has within his CBA. In fact, they COULD reject the notion of public sector collective bargaining agreements outright. Removing in one fell swoop what contractural ‘protection’ these empire builders thought they had.

Nor is it likely that a jury would have much sympathy towards someone collecting 150 grand to work from home and show up once a week to write an edict; if any aspect of this ever DID get to a jury which I doubt.”

As usual, our staff believes Keshawndra is spot on. And we look forward to finally downsizing this bureaucratic behemoth that loves to tell people how to live their lives while relieving them of their money in the process.

As well as holding those accountable who lied to the American People and used Lawfare to prosecute good American citizens.
